These terms and conditions (“Terms”) govern your use of this website and the surf coaching, yoga, retreats and related services (“Services”) provided by [Your full name], trading as “WaveRetreat” (“we”, “us”, “our”), a sole trader based in Cornwall, England, with a correspondence address at [your business address] and contact email hello@waveretreat.com.
By booking a session or retreat, or by using this website, you agree to these Terms. Please read them carefully. If you do not agree, please do not use our Services or this website.
1. Definitions
- “Booking” means a confirmed reservation for any of our Services.
- “Participant” means any person taking part in a Service, including anyone you book on behalf of.
- “Session” means a surf lesson, yoga class, corporate day or other individual activity.
- “Retreat” means a multi-day surf and yoga package.
2. Bookings & payment
- A Booking is confirmed only once we have accepted it and received any required deposit or full payment.
- Prices are as quoted at the time of Booking and are in pounds sterling (£). We reserve the right to change prices for future Bookings.
- For retreats, a deposit of [deposit amount/percentage] is payable at the time of Booking, with the balance due [number] days before the start date. Failure to pay the balance on time may result in cancellation and loss of deposit.
- Payments are processed by [payment provider, e.g. your booking system / Stripe / PayPal]. We do not store your full card details.
- You are responsible for ensuring all information provided at Booking is accurate.
3. Cancellations & changes by you
- To cancel or amend a Booking, please contact us as soon as possible at hello@waveretreat.com.
- Our cancellation and refund schedule is: [set out your policy, e.g. full refund if cancelled 7+ days before; 50% if 3–7 days; no refund within 48 hours].
- Because Services are supplied on a specific date or for a specific period of leisure activity, the 14-day “cooling-off” right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not normally apply. Your statutory rights are not otherwise affected.
- If you arrive late or miss a Session, we are not able to extend or refund it.
4. Cancellations & changes by us
- Surfing depends on weather, tides, surf and sea conditions. For reasons of safety, we may cancel, shorten, postpone or relocate a Session at any time.
- If we cancel a Session for safety or operational reasons, we will offer you a reasonable alternative date or a refund or credit for the affected Session.
- We are not liable for any travel, accommodation or other costs you incur in connection with a cancelled or rearranged Session, and we recommend you take out suitable travel and activity insurance.
- In exceptional circumstances beyond our reasonable control (see “Events outside our control”), different arrangements may apply.
5. Health, fitness & ability
- You must be able to swim and be in good general health to take part in surfing. You agree to tell us, before the Session, about any medical condition, injury, disability, allergy or other matter that may affect your or others’ safety.
- You must declare if a Participant is pregnant or has any condition that may be affected by physical activity or cold water.
- We may refuse participation, or require a Participant to stop, where we reasonably believe it is unsafe to continue. No refund is due in these circumstances.
- Participants under 18 must have consent from a parent or guardian, who is responsible for completing any health declaration. Minimum ages and supervision requirements apply as advised at Booking.
6. Assumption of risk
You understand and accept that surfing, bodyboarding, swimming, yoga, breathwork, cold-water and other activities we provide are physically demanding and carry inherent risks, including the risk of serious injury or, in rare cases, death, arising from waves, currents, rocks, marine life, weather, equipment and the actions of yourself and others. You take part voluntarily and accept these inherent risks. This clause does not limit our liability where it cannot lawfully be limited (see “Our liability”).
7. Your responsibilities
- Follow all safety briefings and the reasonable instructions of our coaches at all times.
- Use equipment correctly and only as instructed, and report any damage or fault immediately.
- Do not take part under the influence of alcohol or drugs.
- Behave responsibly and with consideration for our coaches, other Participants, the public and the environment. We may remove any Participant whose behaviour is unsafe, abusive or disruptive, without refund.
- You are responsible for your personal belongings; please do not bring valuables to sessions.
8. Equipment
We provide a surfboard and wetsuit for the duration of a Session unless stated otherwise. Equipment remains our property and must be returned in the condition provided, allowing for fair wear and tear. You are responsible for loss of or damage to equipment caused by misuse or negligence.
9. Our liability
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law (including under the Consumer Rights Act 2015).
- We will provide our Services with reasonable care and skill.
- Subject to the above, we are not liable for loss or damage that is not foreseeable, or for loss arising from your failure to follow instructions, your health condition, or risks inherent in the activities that you have accepted.
- We are not liable for loss of or damage to personal property except where caused by our negligence.
10. Insurance
We hold [public liability / relevant insurance details]. We strongly recommend that you arrange your own personal accident, travel and (for retreats) cancellation insurance appropriate to the activities.
11. Photography & media
We may take photographs or video during Sessions and retreats for coaching feedback and marketing. If you do not wish you or those in your party to appear in our marketing, please tell us in writing before the Session and we will respect your request.
12. Gift vouchers
Where offered, gift vouchers are valid for [validity period] from the date of purchase, are non-refundable and non-transferable for cash, and are subject to availability.
13. Events outside our control
We are not responsible for any failure or delay in performing our obligations caused by events outside our reasonable control, including severe weather, sea conditions, fire, flood, illness or epidemic, strikes, or acts of government. Where such an event affects a Booking, we will contact you and work with you to rearrange or, where appropriate, refund or credit affected Services.
14. Website use & intellectual property
- This website and its content (text, images, logos and design) are owned by us or our licensors and are protected by intellectual property laws. You may view and use the site for personal, non-commercial purposes only.
- You may not copy, reproduce or redistribute any content without our prior written permission.
- We aim to keep the site available and accurate but do not guarantee it will be uninterrupted or error-free, and we may change or suspend it at any time.
15. Privacy
We process personal data in line with our Privacy Policy, which forms part of these Terms.
16. Changes to these Terms
We may update these Terms from time to time. The version in force is the one published on this website at the date of your Booking. Please check this page before each Booking.
17. Governing law & jurisdiction
These Terms and any dispute arising from them are governed by the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.
